The Demise of the 28-Clause Peace Initiative for Ukraine: How Diplomatic Efforts Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis caused by the announcement of a new comprehensive peace framework for ending the war appeared – temporarily – to have been contained. A senior US official spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its countermove: another massive barrage of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The chain of opposing developments captured the harsh reality of the outgoing year. By day, diplomatic battles are fought: positive announcements are issued from multiple capitals. Significant resources is expended on restraining certain initiatives. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the key method for achieving "resolution".

Nocturnal Warfare

As military strikes developed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was laid bare. Ukraine is equipped to monitor rocket firings from across the border, a capacity provided through timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to engage hostile guided weapons streaked across the sky – advanced fighter aircraft supplied to Ukraine by Western partners.

Shortly after, Kyiv's missile defense engaged: defensive missiles fired to intercept a incoming threat. This was a sophisticated defense system at work, probably delivered by allied countries. Every deployment jolts you unexpectedly, rattling buildings. The instant of fear quickly transforms into sober acceptance: possibly the hostile projectile won't strike its target this time, preventing destruction from ruin and additional electricity failures.

Persistent Threats

Soon after, a large-caliber weapon engaged a drone close by, part of a mobile-fire group – probably Western-made equipment. Regrettably, the shots failed to hit the hostile drone – it maintained course toward its target.

With pauses, this continued until dawn. Kyiv awoke to the early updates: multiple fatalities, damage and heating outages in many homes as a result of the nocturnal offensive. As typically, everyone still continued their routines – enduring hostilities. But those entire period demonstrated Ukraine's vital need on external assistance – a need that regional partners are demonstrably unable to replace in the immediate future.

Unsuccessful Negotiations

The detailed framework from American leadership provoked deep reactions, controversy and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after prior negotiation attempts and multilateral gatherings.

Every new proposal from American administration adheres to the identical sequence: a political offensive against Ukraine, which Kyiv, with partner nations, manages to fend off. They contain the crisis but never actually achieve victory. This trend will, certainly, continue.

Strategic Calculations

It is convenient to criticize particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the whole story. American leadership functions according to a premise understood by seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The US administration presumes that it is impossible to compel Moscow to relinquish the land that it presently holds in Ukraine's occupied territories.

The problem is that while accepting these circumstances, American administration does minimal to prevent Kremlin actions, through statements or actions, from assuming that the current condition will not shift further in its advantage in the coming year.

Opposing Positions

Therefore, the Kremlin is confident that time is on his side – that Ukraine and its partners are nearing depletion. Their motivation to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be multiple initiatives to stop fighting, but they will continue as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing people and territory but preventing a entire defensive failure until conditions improve in its benefit.

Present Conditions

Objectively, there are no actual prerequisites for a ceasefire. Now, personal considerations are entering the equation: leadership ambitions to broker a ceasefire and secure international recognition, and Kyiv's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any initiative Kyiv finds unacceptable, so that their priority does not switch to internal issues. And although their mission will now be significantly challenging after current events, it remains highly unlikely that this will modify their basic position.

These two forces are driving the talks.

Assessment and Future

It took a mere seven days to terminate the proposed articles of the current initiative. Forceful and unpredictable management of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with calming attempts of representatives, and finally, latest revelations, all served their function.

While new initiatives based on previous concepts are imminent, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to fend off political attacks from Washington that are founded on Moscow's terms and reflect certain reluctance to modify developments, if they stand together and improve their protective measures at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the predictable period, largely rely on sustained allied backing.
